• US free speech lawyer defends satire of Glenn Beck

">
US free speech lawyer defends satire of Glenn Beck

Sunday, October 4, 2009

Massachusetts-based First Amendment rights lawyer Marc Randazza is defending a controversial parody website which satirizes American political commentator Glenn Beck. The website was created in September by a man from Florida named Isaac Eiland-Hall, and it asserts Beck uses questionable tactics “to spread lies and misinformation”.

The website created by Eiland-Hall is located at the domain name “www.GlennBeckRapedAndMurderedAYoungGirlIn1990.com”. Its premise is derived from a joke statement made by Gilbert Gottfried about fellow comedian Bob Saget. The joke was first applied to Beck on the Internet discussion community Fark. It then became popular on Internet social media sites including Reddit and Digg, and was the subject of a Google bomb, a technique where individuals link phrases in order to artificially change Google search results.

Eiland-Hall saw the discussion on Fark, and created a website about it. The website asserts it does not believe the rumors to be true, and states: “But we think Glenn Beck definitely uses tactics like this to spread lies and misinformation.” In an interview with Ars Technica, he said the website was “using Beck’s tactics against him”. The website was created on September 1, and by September 3 attorneys for Beck’s company Mercury Radio Arts took action. Beck’s lawyers sent letters to the domain name registrar where they referred to the domain name itself as “defamatory”, but they failed to get the site removed.

Even an imbecile would look at this Web site and know that it’s a parody.

Beck filed a formal complaint with the Switzerland-based agency of the United Nations, the World Intellectual Property Organization. Beck alleged that the website’s usage is libelous, bad faith, and could befuddle potential consumers. Beck’s complaint was filed under the process called the Uniform Domain Name Dispute Resolution Policy. The policy allows trademark owners to begin an administrative action by complaining that a certain domain registration is in “bad faith”. A lawyer for Beck declined to provide a comment to the Boston Herald, however a source told the newspaper that Beck’s complaint with the site is primarily a “trademark issue”.

Randazza established an attorney-client relationship with Eiland-Hall after his client received threatening letters from attorneys representing Beck. He then sent an email to Beck’s attorneys, and pointed out inconsistencies between their client’s recent actions and his prior public statements in support of the First Amendment. Randazza wrote a reply to the World Intellectual Property Organization, and contends that the website is “protected political speech”, because it is “satirical political humor”. Randazza stated that “Even an imbecile would look at this Web site and know that it’s a parody.” In his legal brief, Randazza compared the website to other Internet memes, such as “All your base are belong to us” and video parodies of the German film Downfall.

It’s not often that I would recommend reading a World Intellectual Property Organization legal brief for its entertainment value, but today is going to be an exception.

“We are here because Mr. Beck wants Respondent’s website shut down. He wants it shut down because Respondent’s website makes a poignant and accurate satirical critique of Mr. Beck by parodying Beck’s very rhetorical style,” wrote Randazza in the brief. The brief also commented on Beck’s style of reporting, and pointed out a controversial statement made by Beck when he interviewed a Muslim member of the United States Congress. Beck said to Representative Keith Ellison: “I like Muslims, I’ve been to mosques. … And I have to tell you, I have been nervous about this interview because what I feel like saying is, sir, prove to me that you are not working with our enemies.” According to the Citizen Media Law Project, the website’s joke premise takes advantage of “a perceived similarity between Beck’s rhetorical style and the Gottfried routine”.

Public interest attorney Paul Levy told Ars Technica that if a statement in a website’s domain name were both false and “stated with actual malice”, it is possible it could be considered defamatory. The First Post reported that Electronic Frontier Foundation attorney Corynne McSherry gave an analysis asserting that though the domain name of the website is “pretty dramatic”, it constituted “pure political criticism and there’s nothing wrong with that”. McSherry and Levy both agreed that the action of Beck to take the matter to the World Intellectual Property Organization was probably a tactic to determine the identity of the website’s owner.

Andy Carvin of National Public Radio wrote that Randazza’s legal brief was amusing, commenting: “It’s not often that I would recommend reading a World Intellectual Property Organization legal brief for its entertainment value, but today is going to be an exception.” Nate Anderson of Ars Technica commented “In any event, the WIPO battle promises to be entertaining, and there’s even a bit of serious purpose mixed in with the frivolity. Just how far can WIPO go in using its domain dispute system to address Internet spats?”. Domain Name Wire wrote that “…when someone who has created a bitingly satirical web site works with his lawyer to put pen to the paper, the end result can be quite amusing.”

Writing for Adweek, Eriq Gardner pointed out the comparison made by Randazza’s legal brief between the website’s parody nature itself and the statement made by Beck to Congressman Ellison, noting: “this case also makes a political point”. Jack Bremer wrote in The First Post that the attempts by Beck’s lawyers to argue that the website’s domain name is itself defamatory “looks like a first in cyber law”. Rick Sawyer of Bostonist characterized Randazza’s legal brief as “Hillarious!”, and called the attorney “among the North Shore’s most hilarious legal writers”.

[Glenn Beck] did the one thing guaranteed to garner the greatest amount of publicity for the site…

The FOX News-critical site FoxNewsBoycott.com likened the legal conflict between Beck and the site to the Streisand effect, a phenomenon where an individual’s attempt to censor material on the Internet in turn proves to make the material itself more public. “Glenn Beck is experiencing the Streisand Effect first hand,” wrote FoxNewsBoycott.com. John Cook of Gawker.com also compared Beck’s actions to the Streisand effect: “Now Glenn Beck’s trying to shut down their web site, ensuring that people will write about it.” Jeffrey Weiss of Politics Daily wrote that by taking legal action, Beck “did the one thing guaranteed to garner the greatest amount of publicity for the site”. Techdirt described Beck’s legal action as “not particularly smart”, and noted: “Beck would have been better off just ignoring it. Instead, in legitimizing it by trying to take it down, many more people become aware of the meme — and may start calling attention to situations where Beck (and others) make use of such tactics.” The blog Hot Air noted the issue could gain attention if it becomes a test case for the First Amendment: “If this becomes a First Amendment test case, the smear’s going to be covered far and wide…”

By Mr.Andrew Caxton

Many homeowners are now opting to built sunrooms in their home because of different reasons. First, having a sunroom into your very home can add additional appeal and value to your humble abode. And second, building a sunroom is not as expensive as everyone thinks. The market now offers do-it-yourself sunroom kits that could spare you from spending a huge amount of money. With this kit, you can now built your very own sunroom without the assistance of a professional. The outcome is still the same so you can now draw a big grin on your face because of the fruit of your labor. In most cases, the cost of building a sunroom could range from $12,000 up to $70,000. These prices would depend on the total area, materials and designs used for your sunroom. If you try to compare the cost of sunroom to a traditional house, you will notice that sunrooms are a lot more economical and they can pay you back with more than 70% of your original investment in the fastest way possible.

Deciding on where to put the sunroom is a huge aspect in the planning stage. Placing it in front of the house may be a good thing however it can give you several setbacks such as it can ruin your budget plan. So, if you are only on a limited budge, it is important that you settle all the budgetary issues first before delving on the planning stage. You need to determine that actual cost of all the raw materials, labor cost and the furniture items and from there you can now settle your financial constraints in building a sunroom. If you think that your budget is still enough to availing of better materials, then it would be advisable if you go for the high quality ones. The materials to be used in the sunroom should be enough in the roofing system, doors, windows and other furniture items.

You would actually wonder why even if a sunroom could be an additional burden to your budget, many still opts to build a sunroom in their homes. The answer is plain and simple. A sunroom can create extra space to the rooms. As compared to having additional room, putting up a sunroom is a lot more economical and building it only entails a few weeks. You see, a sunroom is more practical than having a new traditional room made out of bricks and mortar. For this, a sunroom is the wisest choice if you want to increase the space of the rooms in the most economical way.

However, the cost of building a sunroom may vary depending on some factors. The size of the room, materials to be used, drainage facility, location, ventilation, and the style and design of the sunroom are just some of the factors that could determine the cost of the sunroom. People who live in areas where the temperature is hot need to spend a lot more since they need to also employ a cooling system. This also happens to those living in places with cold temperature as they have to spend on a heating system.

The defending champions, the United States women’s national basketball team, are perceived as the Australian Opals’ main competitors. In the last three Olympic Games the Opals got silver medals. In each of these cases the United States got first place. Coach Carrie Graf said “thinking about the US too soon in inappropriate”, “Our focus is first and foremost, game by game winning our pool”. Amongst the Australian Opals’ competitors in the pool are Brazil, Russia, and Great Britain. Carrie Graf said Great Britain “will put up a fight on home turf” but there is a “world class [AIS] facility” and “world class medical support staff” supporting the team.

Australian Opal player Penny Taylor recently suffered injury from a torn anterior cruciate ligament, meaning she cannot play Olympics this year. In regards to the situation player Lauren Jackson, who is going into her fourth Olympics, said “you would never wish that upon anybody.” She says as a team they have to “move on, move through that” and “come together” to pick up their offence and defense. Despite the loss of one of their key players she says “we definitely have the talent there” and the team is all “on the same page.” She feels “pretty confident” and speaks of “very exciting” times ahead. Jenna O’Hea is going into her first Olympics with the team. She is still “pinching” herself and says she is taking it “day by day”.

A typical day at the camp might start with a 7.00am – 8.30am breakfast at the AIS Dining hall, before one and a half or two hours of court, gym, or swimming training. The middle of each day might consist of media meetings, medical checks, team meetings, and time to practise shooting. Around 12.00pm, the players meet to eat lunch and recover from the morning. The afternoon typically consists of more training, and some scrimmage games. Players usually finish around 7.00pm for dinner, and perhaps a massage.

The nineteen players in attendance this week at training camp were Suzy Batkovic, Abby Bishop, Elizabeth Cambage, Rohanee Cox, Cayla Francis, Kristi Harrower, Laura Hodges, Natalie Hurst, Lauren Jackson, Rachel Jarry, Kathleen MacLeod, Jenna O’Hea, Samantha Richards, Jennifer Screen, Belinda Snell, Marianna Tolo, Kristen Veal, Carly Wilson, and Hanna Zavecz. Basketball Australia has named fifteen players that are to attend the second phase of the camp: Suzy Batkovic, Abby Bishop, Elizabeth Cambage, Kristi Harrower, Laura Hodges, Lauren Jackson, Rachel Jarry, Kathleen MacLeod, Jenna O’Hea, Erin Phillips, Samantha Richards, Jennifer Screen, Belinda Snell, Marianna Tolo, and Hanna Zavecz.

Possibility of new graphic health warnings on NZ cigarette packs

Possibility of new graphic health warnings on NZ cigarette packs
Posted in Uncategorized | May 7th, 2018

Wednesday, May 10, 2006

New Zealand Associate Minister of Health Damien O’Connor has proposed that warnings, both images and text, should cover 60% of the packaging of cigarettes sold in the country. New Zealand is required to do so under obligations to the World Health Organisation.

The new images would depict throat cancer, rotting teeth/gums and gangrenous feet. Ashley Bloomfield, Chief Advisor on Public Health, says written warnings aren’t as effective as pictures, and that many smokers do not know most of the diseases that smoking can cause.

If the proposal were adopted, the Ministry would dictate the size and placement of the images to the tobacco companies, but would not subsidise the cost of the changes.

Why Select One Vendor For Truck Parts And Accessories?

Posted in Pipes | May 7th, 2018

byAlma Abell

Business owners understand that the even the best equipment will need repairs and possibly replacement from time to time. While some choose to work with multiple vendors, there’s a lot of wisdom in using one vendor for as many needs as possible. This approach to purchasing necessary truck parts and essentials will provide a couple of important benefits.

Consistency in the Quality of Components

One important feature of working with a single vendor is there is never any issues with the quality of the truck parts and accessories that are purchased. The vendor will carry the same brands and models, making it much easier to know what to expect in terms of price and performance. This is important, since the last thing any business owner needs is to purchase a replacement part and find out that it does not offer the same level of service as parts obtained from a different supplier.

Potential for Volume Discounts

Depending on the amount of purchases that are routinely made during the year, there’s a good chance that funneling all of those purchases through a single vendor will result in some sort of pricing discount. The price breaks can take several different forms. One approach is to enter into what is known as a volume purchasing agreement. This approach commits the client to buy a certain amount of accessories and parts over the life of that contract. In return, the vendor extends some type of percentage discount off the standard pricing.

Another approach to the price discount involves providing discounts on individual orders that total over a certain amount. For example, if the customer agrees to purchase ten units of a certain part, the vendor throws in an eleventh part for free. Even if it may be months before that extra part is used, this approach ends up saving the customer money over the course of a year. There’s one additional benefit to ordering all or at least most accessories and parts through one vendor. High quality vendors like Ameriflex Hose and Accessories understand that the need for a crucial part can arise at any time. By purchasing most of the needed parts through the one vendor, there’s a much better chance that all those parts will be kept in the active inventory and be ready for shipment at any time.

The 32nd round of the English Premiership took place this past weekend with both the battles for the league title and the battle against relegation still raging on. The fate of one team has been sealed for the rest of the season as Derby County has been mathematically guaranteed relegation, setting a new league record for earliest relegation. At the top of the table, nothing changed this week as Manchester United, Chelsea, Arsenal, and Liverpool all won.

United States: Dr. Larry Nassar sentenced in sexual abuse case

United States: Dr. Larry Nassar sentenced in sexual abuse case
Posted in Uncategorized | May 6th, 2018

Saturday, January 27, 2018

Former USA Gymnastics team doctor Larry Nassar was sentenced to prison on Wednesday for 40 to 175 years in Ingham County, Michigan, United States. Nassar pleaded guilty in November to seven charges of sexual assault in Ingham County, however, he is alleged to have victimized over a hundred girls over several years. Nassar is currently serving a 60-year sentence for federal child pornography charges.

Judge Rosemarie Aquilina, presiding over the Ingham County Circuit Court in Lansing, Michigan, handed down the sentence, stating: “I’ve just signed your death warrant.”

Rachael Denhollander first accused Nassar, filing a criminal complaint in 2016. Nassar was charged in Ingham County with seven counts of sexual abuse and pleaded guilty in November of 2017. The true number of victims is alleged to exceed one hundred. During the sentencing hearings in court over 150 women testified Nassar abused them. Alleged victims include famous Olympic gymnasts, such as Simone Biles, Aly Raisman, and Gabby Douglas, although Nassar was not specifically charged with abusing them.

Judge Aquilina read out parts of a statement Nassar submitted to the court. In the statement, Nassar wrote, “I was a good doctor, because my treatments worked and those patients that are now speaking out are the same ones that kept coming back over and over”. He also criticized an earlier judge for going “ballistic”. Aquilina declined to read the entirety, citing concern for the victims; “I don’t want them re-victimized by the words in the letter”, she said.

Nassar served as the team physician for USA Gymnastics for years, spanning four Olympic Games. Simultaneously, he served with Michigan State University. He abused his victims under pretense of treating them as a doctor.

Nassar’s case has led to allegations of lack of oversight by Michigan State University, USA Gymnastics, and the United States Olympic Committee (USOC). At USA Gymnastics, prior to the sentencing three board members resigned over the case on Monday, as well as its president last year. Corporate sponsors of the organization also pulled out.

The current president of USA Gymnastics, Kerry Perry, who was appointed in December, released a statement after the sentencing: “During the last seven days, more than 150 courageous women have shared their deeply personal experiences and how Larry Nassar’s despicable crimes impacted their lives. […] USA Gymnastics applauds Judge Rosemarie Aquilina for handing Nassar the maximum sentence of up to 175 years[…] As stated on my first day on Dec. 1, 2017, I will not waver on my commitment to focus each and every day on our organization’s highest priority — the safety, health and well-being of our athletes.”

USOC head Scott Blackmun also released a statement in which he apologized: “The purpose of this message is to tell all of Nassar’s victims and survivors, directly, how incredibly sorry we are. We have said it in other contexts, but we have not been direct enough with you. We are sorry for the pain caused by this terrible man, and sorry that you weren’t afforded a safe opportunity to pursue your sports dreams. The Olympic family is among those that have failed you.”

Both Reuters and the Los Angeles Times noted applause in the courtroom when Nassar was escorted out. Judge Aquilina said, “There has to be a massive investigation as to why there was inaction, why there was silence.”

Florida man charged with stealing Wi-Fi

Update since publication

This article mentions that Wi-Fi stands for “Wireless Fidelity”, although this is disputed.

Thursday, July 7, 2005

A Florida man is being charged with 3rd degree felony for logging into a private Wi-Fi (Wireless Fidelity) Internet access point without permission. Benjamin Smith III, 41, is set for a pre-trial hearing this month in the first case of its kind in the United States.

This kind of activity occurs frequently, but often goes undetected by the owners of these wireless access points (WAPs). Unauthorized users range from casual Web browsers, to users sending e-mails, to users involved in pornography or even illegal endeavours.

According to Richard Dinon, owner of the WAP Smith allegedly broke into, Smith was using a laptop in an automobile while parked outside Dinon’s residence.

There are many steps an owner of one of these access points can take to secure them from outside users. Dinon reportedly knew how to take these steps, but had not bothered because his “neighbors are older.”
