“When the Federal Trade Commission proposed new rules this spring for multilevel marketers businesses best known for commercials that promise riches selling herbal supplements and beauty supplies it drew howls of protest. Tupperware party-givers, diet pill vendors and knife salesmen sent the agency more than 15,000 letters complaining that the proposed rules would undo a $30-billion-a-year industry.”

The article reports that short stock sellers are now an ally with the FTC – the short sellers are “betting that the stocks of multilevel marketing companies will decline when the new rules, which have received little public attention, go into effect.” (They have not yet – KK.)

The new rules “would require companies to tell potential recruits how many sales representatives have failed to earn more than their start-up costs…”

“If companies have to tell recruits that the average income is only $1,400 instead of the $50,000 advertised on their Web site, or that the average salesman only lasts two months, a lot fewer people are going to sign up, said Mimi Sokolowski, an analyst with Sidoti & Company who follows Tupperware Brands, Nu Skin Enterprises and other publicly traded multilevel marketing companies.”

She ads – “if the proposed rules pass without modification, recruitment in the United States could fall by as much as 40 percent.” (Chances are good the rules will be modified a bit – KK.)

The story uses Pre-Paid Legal as an example of short seller enthusiasm (although they mention Avon, Tupperware, NuSkin, Herbalife, Mannatech, USANA Health Sciences and Medifast.)

“Under the rules, Pre-Paid Legal would have to tell prospects that fewer than a quarter of its sales representatives sold more than one insurance plan in 2005, something it disclosed to investors in a filing with the S.E.C. While Pre-Paids Web site tells prospects that if they market just five memberships per week, youll receive $500 per week! very few representatives have consistently sold five memberships a week.”

Promises are killing our business. Because they aren’t true. It is NOT easy to make money doing this or any other business of one’s own. Plus we don’t know for sure how a product will affect someone else, do we?

The National Transportation Safety Board (NTSB), the agency responsible for investigating transportation accidents in the United States, released updates on three major investigations on June 14.

The NTSB, well known publicly for its involvement in the investigation of aviation incidents which involve harm or loss of human life, is also an agency that oversees the transportation of refined petroleum and gas products, chemicals and minerals.

The agency determined the cause of a natural gas pipeline explosion that killed six. It also detailed the cause of an accidental release of 204,000 gallons of anhydrous ammonia from a pipeline in an environmentally sensitive area, and released preliminary information involving two commercial aircraft coming within 30-50 feet of each other on a runway.

In the gas explosion disaster, the towing vessel Miss Megan, which was of specifications that did not require inspection by the United States Coast Guard, was being operated in the West Cote Blanche Bay oil field in Louisiana by Central Boat Rentals on behalf of Athena Construction on October 12, 2006. The Miss Megan was pushing barge IBR 234, which was tied along the starboard side of barge Athena 106, en route to a pile-driving location. Athena Construction did not require its crews to pin mooring spuds (vertical steel shafts extending through wells in the bottom of the boat and used for mooring) securely in place on its barges and consequently this had not been done. During the journey, the aft spud on the Athena 106 released from its fully raised position. The spud dropped into the water and struck a submerged, high-pressure natural gas pipeline. The resulting gas released ignited and created a fireball that engulfed the towing vessel and both barges. The master of the towing vessel and four barge workers were killed. The Miss Megan deckhand and one barge worker survived. One barge worker is officially listed as missing.

The NTSB blames Athena Construction for the disaster, citing in the final report that Athena Construction’s manual contained no procedures mandating the use of the safety devices on the spud winch except during electrical work. It was found that if the Athena 106 crew had used the steel pins to secure the retracted spuds during their transit, a pin would have prevented the aft spud from accidentally deploying. Furthermore, the spud would have remained locked in its lifted position regardless of whether the winch brake mechanism, the spud’s supporting cable, or a piece of connecting hardware had failed.

The NTSB also found that contributing to the accident was the failure of Central Boat Rentals to require, and the Miss Megan master to ensure, that the barge spuds were securely pinned before getting under way. The Board noted that investigators found no evidence that the Miss Megan master or deckhand checked whether the spuds had been properly secured before the tow began. While Central Boat Rentals had a health and safety manual and trained its crews, the written procedures did not specifically warn masters about the need to secure spuds or other barge equipment before navigating. The NTSB stated that the company’s crew should have been trained to identify potential safety hazards on vessels under their control.

NTSB Chairman Mark Rosenker said of the investigation’s results, “Having more rigorous requirements in place could have prevented this accident from occurring. Not only do these regulations need to be put in place but it is imperative that they are enforced and adhered to.”

The NTSB has made a number of safety recommendations as a result of this accident and the subsequent investigation. Recommendations were made to Athena Construction and Central Boat Rentals to develop procedures and train the employees of its barges to use the securing pins to hold spuds safely in place before transiting from one site to another.

The most major of the other recommendations are:

To the Occupational Safety and Health Administration:

  • Direct the Maritime Advisory Committee for Occupational Safety and Health to issue the following documents document to the maritime industry: (1) a fact sheet regarding the accident, and (2) a guidance document regarding the need to secure the gear on barges, including spud pins, before the barges are moved, and detailing any changes to your memorandum of understanding with the Coast Guard.

To the U. S. Coast Guard

  • Finalize and implement the new towing vessel inspection regulations and require the establishment of safety management systems appropriate for the characteristics, methods of operation, and nature of service of towing vessels.
  • Review and update your memorandum of understanding with the Occupational Safety and Health Administration to specifically address your respective oversight roles on vessels that are not subject to Coast Guard inspection.

The NTSB also released the result of its investigation into an environmental disaster in Kansas on October 27, 2004 in which 204,000 gallons (4,858 barrels) of anhydrous ammonia was spilled from a ruptured pipeline in Kingman into an environmentally sensitive area. Chemicals from the pipeline entered a nearby stream and killed more than 25,000 fish, including some fish from threatened species.

The incident reached the scale that it did due to operator error after the initial rupture. The 8 5/8-inch diameter steel pipeline, which was operated by Enterprise Products Operating L.P., burst at 11:15 a.m. in an agricultural area about 6 miles east of Kingman, Kansas. A drop in pipeline pressure, indicating abnormal conditions or a possible compromise in pipeline integrity, set off alarms displayed on the computerized pipeline monitoring system. Shortly after the first alarm the pipeline controller, in an attempt to remedy the low pressure, increased the flow of anhydrous ammonia into the affected section of pipeline. A total of 33 minutes elapsed between the time when the first alarm indicated a problem with the pipeline and the initiation of a shutdown.

In its initial report to the {{w|National Response Center|National Response Center|| (NRC), the pipeline operator’s accident reporting contractor reported a release of at least 20 gallons of ammonia, telling the NRC that an updated estimate of material released would be reported at a later time. No such report was ever made. Because of the inaccurate report, the arrival of representatives from the Environmental Protection Agency was delayed by a full day, affecting the oversight of the environmental damage mitigation efforts.

The cause of the rupture itself was determined to be a pipe gouge created by heavy equipment damage to the pipeline during construction in 1973 or subsequent excavation activity at an unknown time that initiated metal fatigue cracking and led to the eventual rupture of the pipeline.

“We are very fortunate that such highly toxic chemicals of the size and scope involved in this accident were not released in a populated area,” commented Rosenker. “Had this same quantity of ammonia been released near a town or city, the results could have been catastrophic.”

As a result of this accident, the NTSB made the following safety recommendations:

To the Pipeline and Hazardous Materials Safety Administration:

  • Require that a pipeline operator must have a procedure to calculate and provide a reasonable initial estimate of released product in the telephonic report to the National Response Center.
  • Require that a pipeline operator must provide an additional telephonic report to the National Response Center if significant new information becomes available during the emergency response.
  • Require an operator to revise its pipeline risk assessment plan whenever it has failed to consider one of more risk factors that can affect pipeline integrity.

To Enterprise Products Operating L.P.:

  • Provide initial and recurrent training for all controllers that includes simulator or noncomputerized simulations of abnormal operating conditions that indicate pipeline leaks.

“The severity of this release of dangerous chemicals into the community could have been prevented,” said Rosenker. “The safety recommendations that we have made, if acted upon, will reduce the likelihood of this type of accident happening again.”

As well as concluding their investigation of the above accidents, the NTSB also released preliminary information regarding a serious runway incursion at San Francisco International Airport between two commercial aircraft on May 26, 2007.

At about 1:30 p.m. the tower air traffic controller cleared SkyWest Airlines flight 5741, an Embraer 120 arriving from Modesto, California, to land on runway 28R. Forgetting about the arrival airplane, the same controller then cleared Republic Airlines flight 4912, an Embraer 170 departing for Los Angeles, to take off from runway 1L, which intersects runway 28R.

After the SkyWest airliner touched down, the Airport Movement Area Safety System (AMASS) alerted and the air traffic controller transmitted “Hold, Hold, Hold” to the SkyWest flight crew in an attempt to stop the aircraft short of runway 1L. The SkyWest crew applied maximum braking that resulted in the airplane stopping in the middle of runway 1L. As this was occurring, the captain of Republic Airlines flight 4912 took control of the aircraft from the first officer, realized the aircraft was traveling too fast to stop, and initiated an immediate takeoff. According to the crew of SkyWest 5741, the Republic Airlines aircraft overflew theirs by 30 to 50 feet. The Federal Aviation Administration has categorized the incident as an operational error.

The NTSB sent an investigator to San Francisco, who collected radar data, recorded air traffic control communications, and flight crew statements, and interviewed air traffic control personnel prior to the NTSB making the preliminary release.

    A man shot a faculty physician as well as his own mother before killing himself at Johns Hopkins Hospital in Baltimore, Maryland. The shooting occurred on the eighth floor of the Nelson Building, the hospital’s main building. Baltimore police found the suspected shooter, who had been barricaded inside his mother’s hospital room for several hours before killing himself and his mother.

    At around 11:15 a.m. EDT (1515 UTC), an unnamed doctor was shot in the chest at a patient area of the Nelson Building’s thoracic center. All major hospital facilities were placed under a lockdown, and some medical personnel were evacuated from the Nelson Building. The doctor was sent to surgery at the hospital, and police spokesperson Anthony Guglielmi said that the doctor will likely survive the incident. He was not aware of any connections between the suspect and the doctor, who was in critical condition.

    A nurse at the hospital told The Baltimore Sun that the shooter was dissatisfied with how his mother had been treated and even said that he was going to jump out of a window. The nurse said that, upon hearing gunshots, she ran.

    Earlier, Baltimore area police said that they were “in the process of a tactical operation” to capture the gunman, who was holed up on the eighth floor. A spokesperson for the Federal Bureau of Investigation (FBI) said that it had been assisting local police in the incident. A Johns Hopkins spokesperson had previously said that authorities had taken the shooter into custody, but police said that the report was incorrect.

    The suspect, who had not taken any hostages, was described as a black man in his thirties. After a standoff lasting for three hours, law enforcement officers moved into his mother’s hospital room, and found both him and his mother dead from gunshot wounds to their heads. The suspect was first identified as 50-year-old Warren Davis, and his mother as Jean Davis. Police later said that “Warren Davis” was an alias and that his real name was not known.

    Baltimore Police Commissioner Frederick Bealefeld, who said that the department is “treating this case as a murder-suicide,” said that no officers reported hearing the shots that killed the two. Police had previously said that the gunman had been shot and killed by police, but police later said that that report was incorrect.

    Web.com, a web-hosting and online services company, has released its second quarter financial results and associated statements – and it’s clear that the company has experienced both the ups and downs of executing on its goals.

    On the upside, the company achieved an industry-first achievement of securing a non-exclusive license agreement with Hostopia.com Inc. last month. The agreement granted Hostopia rights to two of Web.com’s patents over five years on a non-transferable basis. The specific licensed patents were U.S. Patent numbers 5,680,152 and 6,789,103 and broadly cover methods for website building and web hosting control panels. Importantly for revenues, the license agreement states that Hostopia will pay Web.com a royalty equal to 10% of their gross U.S. retail revenues for five years.

    On the downside, the company failed to deliver on the expected and announced acquisition of Houston-based WebSource Media – a business offering “easy and affordable built-to-order websites”. The announced acquisiton was to have added about $9 million in annual revenue to Web.com.

    However, according to published reports from Web.com, the company filed to rescind its acquisition of WebSource media just about one month after the announcement. This action was taken after the Federal Trade Commission filed a sealed action in the United States District Court for the Southern District of Texas against WebSource Media, L.L.C. and its members – alleging unfair and deceptive acts and business practices prior to the acquisition.

    In a press release issued by Web.com, President and CEO Jeff Stibel discussed the effects of the rescinded acquisition on the second quarter resutls, “Web.com continued to drive subscriber growth across its core website and web services plans by refining our sales and marketing efforts and working closely with strategic distribution partners. While we had unfortunate news about an acquisition we made during the quarter, the company has moved on and is working on further solidifying its position as a leader in the industry.”

    On the financial side of the report, Web.com reported that total revenues for the quarter were $12.1 million, down from $12.3 million in the first quarter of 2006. The second quarter marked the last quarter of recognizing Verizon revenues (a deal that was initially cancelled in December 2004 and terminated in the second quarter of 2006).

    On the organic customer acquisition side of the equation, the company reported that net subscribers totaled approximately 148,000 for the quarter, down from approximately 149,000 in the first quarter of 2006. The reduction in the second quarter as compared to the first quarter includes the loss of approximately 3,200 Verizon subscribers. Excluding the loss of Verizon subscribers, the company added approximately 1,600 subscribers in the quarter.

    Yesterday, United States House of Representatives Speaker Nancy Pelosi confirmed a vote will be held today to decide whether to submit two articles of impeachment, passed against President Donald Trump, to the U.S. Senate.

    Mitch McConnell, the Senate Majority Leader, has indicated the trial could possibly commence on Tuesday, January 21, subject to agreement on the procedures to be followed. McConnell has expressed a preference to proceed similarly to the impeachment trial of President Bill Clinton in 1998.

    Pelosi also mentioned the House will appoint as yet unnamed impeachment managers to conduct the prosecution in the trial. “The American people deserve the truth, and the Constitution demands a trial.” Pelosi said. Additionally, the House must allocate money for the trial.

    On December 18, the House passed two articles of impeachment. The first charged President Trump with abuse of power, and the second accused him of obstruction of Congress.

    Newspaper The Guardian reports today that the sale of the BBC subsidiary BBC Resources Ltd., has cost £3.4m in consultancy fees — over £1m more than the £2.3m trading profit the commercial division is estimated to have made for the last financial year. Details of the failed privatisation were released by the BBC following a freedom of information request, and prior to publication of its annual report on July 8.

    Fourteen months after advisers were appointed to try to sell BBC Resources Ltd., only one of the three main business units has been sold — its Outside Broadcast division to Satellite Information Services Limited (SIS), for an estimated £20m. On March 7, 2008 it was also announced that the studios operation would remain in BBC ownership and in early June, the fate of the third business was put on hold with the BBC stating that “like Studios, Post Production will remain within BBC Resources, which will continue to operate as a wholly-owned commercial subsidiary of the BBC.”

    BBC Resources Ltd. made an operating profit of £6.1m for 2005-06, down from £7.4m the year before, with the BBC accounting for 83.3% of its turnover, down from 87.4% for 2004-05. Last year’s published figure for 2006-07 was £5.2 million — with BBC business at 80% of turnover.

    BECTU Assistant General Secretary Luke Crawley is quoted as saying: “It’s fairly outrageous that around half the profit of the company [announced last year] has been spent trying to sell it. It’s an inordinate amount of money. The BBC was promised big returns if it sold BBC Resources but it’s only managed to sell outside broadcasts and we do not know how much it made out of that. We think the £3.4m is a poor investment.”

    A suicide tractor bombing struck the American held Abu Ghraib prison camp Monday, the 2nd attack in two days. Four Iraqi civilians are reported wounded.

    The explosion occurred near the gates to the prison camp, and comes on the heels of a large attack earlier on Saturday, where both US soldiers and Iraqi detainees were injured. The apparent motive of the Saturday attack was to free detainees.

    The New York Times reports that an official of the Interior Ministry said a letter was written by a woman who claims to be a detainee at the prison. In the letter, she reportedly begs to have the prison attacked to save her from the dishonor of rape by her American captors. The letter was circulated among Sunni mosques.

    An internet posting by the Jordanian militant Abu Musab al-Zarqawi claims responsibility for both the Abu Ghraib attacks. The Al Qaeda militant group also claimed responsibility for the first attack.

    The report of the tractor bombing came as military officials were announcing that a short riot broke out Friday in another American prison called Camp Bucca. Rocks were thrown and tents set on fire during a protest over several prisoners who were being transferred. Four guards and twelve prisoners were injured.

    Australian federal member of Calare, Peter Andren died on Saturday after a short battle with pancreatic cancer. He was aged 61.

    Mr Andren who had held the seat since being elected in 1996 had previously announced his intention to run for the senate after his electorate was changed for the 2007 federal election. After Mr Andren was diagnosed with cancer in July, he announced that he would be retiring from politics at the election.

    Mr Andren’s 1996 campaign platform was based upon retaining services in regional Australia, particularly banking, health and telecommunications. Over the next 11 years, Mr Andren’s primary vote grew and at the 2001 and 2004 elections was elected without preferences, achieving a majority primary vote.

    In 2001, Mr Andren disagreed with his electorate on refugees. The electorate supported the government’s tough stance but Mr Andren could not support the government’s border protection measures. Following this, a vicious letter-box campaign rose up saying “you might like Peter Andren … but you won’t like what he’s got to say about keeping our borders safe”.

    Fellow NSW independent member, Tony Windsor said Mr Andren’s stance on asylum seekers was just one sign of his compassion and strong belief in human rights.

    Mr Windsor described Mr Andren as the “conscience” of parliament. “Peter Andren was a true representative of the people of the Calare electorate, a man of the highest integrity and the conscience of the Parliament,” he said.

    “He was subjected to vitriol from time to time within the Parliament over issues, but if he believed in something he stuck to it. He didn’t compromise and I think that’s a lasting legacy that Peter will leave.”

    Prime Minister John Howard said despite having a difference of opinion with Mr Andren on many issues, he had a lot of respect for him.

    “I respected his skills as a local member,” he said.

    “Mr Andren and I frequently disagreed on major issues and he made no bones about that and I made no bones about it either but that didn’t stop me respecting him and acknowledging the tremendous work he did for his electorate.”

    Labor leader Kevin Rudd described Mr Andren as a true independent.

    “Peter Andren will be a great loss to the Australian parliament,” he said.

    “He was a man of principle, a man of commitment, a man who was an absolute independent.”

    Leader of the Greens, Bob Brown said Mr Andren was an example of how a politician should be.

    “He was an exemplar of representative politics for his electorate and the people of Calare kept returning him with a bigger and bigger majority,” he said.

    “[If] anybody ever asks me how a politician should be, I am going to say, ‘Look at the record of Peter Andren'”

    “He was a great Australian representative and he is a great loss to this country.”

    During his political career, Mr Andren fought the sale of Telstra, introduced a bill to allow MPs to opt-out of their generous superannuation schemes, opposed the Iraq war and campaigned on environmental issues.

    Mr Andren was born at Gulargambone, near Dubbo in Western NSW in 1946. Before he entered politics Mr Andren worked as a teacher before moving into journalism. Mr Andren worked as a news producer in Sydney for the Seven and Nine networks, before moving back to regional NSW where he worked as the news editor for both Radio 2GZ and Prime Television.

    Mr Andren is survived by his partner and two sons.
